The updated procedural rules and guidance for energy code modification appeals replace the rules (CC10) and guide (CC11) and have been amended to

  • reflect the updated legislative framework
  • incorporate the CMA’s experience of conducting appeals
  • align them more closely to the CMA70 rules and CMA71 guide in place for energy licence

The updated procedural rules and guidance for energy code modification appeals replace the rules (CC10) and guide (CC11) and have been amended to

  • reflect the updated legislative framework
  • incorporate the CMA’s experience of conducting appeals
  • align them more closely to the CMA70 rules and CMA71 guide in place for energy licence modification appeals issued in 2022
  • reflect the use of technology to reduce administrative burdens

They also take into account changes to the Energy Act 2004 introduced since the first consultation by the commencement of section 201 and Schedule 14 of the Energy Act 2023, which were introduced in this November consultation.


About this consultation

The Competition and Markets Authority (CMA) consulted further on updated draft procedural rules and guidance for energy code modification appeals to replace the rules (CC10) and guide (CC11). The consultation followed on from the CMA’s consultation on draft rules of procedure and guidance for energy code modification appeals which took place from 23 July to 3 September 2024.

This second consultation sought the views of interested parties on the CMA’s proposed changes to the draft updated Rules and Guide to take into account changes to the Energy Act 2004 introduced since the July consultation by the commencement of section 201 and Schedule 14 of the Energy Act 2023.
