About this consultation

The Competition and Markets Authority (CMA) is consulting on its intention to accept commitments offered by 7 of the largest housebuilders in Great Britain in relation to the CMA’s investigation into suspected breaches of competition law under the Chapter I prohibition of the Competition Act 1998.

The housebuilders, which are all parties to the CMA’s investigation, are:

  • Barratt Redrow plc and its group companies
  • Bellway plc and its group companies
  • The Berkeley Group plc and its group companies
  • Bloor Homes Limited and its group companies
  • Persimmon plc and its group companies
  • Taylor Wimpey plc and its group companies
  • Vistry Group plc and its group companies (collectively, ‘the Parties’)

The CMA’s investigation relates to concerns that the Parties each shared competitively sensitive information with one or more of the other Parties and/or certain other housebuilders and this may have had the object or effect of preventing, restricting or distorting competition within local areas across Great Britain.

Proposed commitments

To address the competition concerns the CMA has identified during the course of its investigation, the Parties have offered commitments to: 

  • not share competitively sensitive information with competitors

  • support the Home Builders Federation and Homes for Scotland to produce and publish guidance on information exchange for the wider housebuilding industry

  • pay £100 million in aggregate to programmes supporting the construction of affordable housing in the United Kingdom

  • introduce enhanced in-house compliance measures and training programmes

For the reasons set out in its Notice of Intention to Accept Commitments, the CMA provisionally considers that the proposed commitments address the competition concerns it has identified and, subject to consultation responses, the CMA proposes to accept the proposed commitments.
